Cyprus Power of Attorney 2026: How to Grant One from Abroad for Property, Company and Banking

A practical 2026 guide to granting a Cyprus power of attorney remotely: general versus special PoA, notarisation and apostille, using it for property purchases, company formation and banking, plus how to revoke it.

Relocating to Cyprus, buying an apartment in Limassol or incorporating a holding company rarely lines up neatly with a flight. A power of attorney (PoA) is the instrument that lets a trusted person — usually a Cyprus advocate — carry out defined acts in your name while you stay abroad. The formalities are governed by the certification rules under the Certifying Officers Law and the general agency provisions of the Contract Law.Certifying Officers Law, Cap. 39

This guide explains the two types of PoA, exactly how to sign one from outside Cyprus, how it is used for property, company and banking matters in 2026, and how to revoke it. What is a Cyprus power of attorney?

A power of attorney is a written instrument by which a principal authorises an agent (the "attorney") to do specified legal acts on the principal's behalf. In Cyprus its effect flows from the law of agency in the Contract Law, and its formal validity depends on the signature being certified by an authorised officer.

The general principles of agency — how authority is created, its scope, and how it ends — sit in the agency sections of the Contract Law, Cap. 149. General vs special power of attorney: which do I need?

A general PoA grants broad authority to act across many matters; a special (specific) PoA is confined to defined acts. For remote transactions almost everyone should use a special PoA scoped tightly to the deal — it is safer, more readily accepted by the Land Registry, Registrar and banks, and cheaper to stamp.

The practical rule: match the scope to the task. If the only goal is to purchase and register a specific apartment, the PoA should name that apartment and list the exact steps — sign and deposit the contract, apply for any foreign-buyer consent, pay fees, accept transfer. A broadly worded general PoA handed to a person you do not know well is the single biggest avoidable risk in a remote Cyprus transaction.

How do I sign a Cyprus power of attorney from abroad?

Sign the PoA before a notary public in your country, then have the notary's signature authenticated. From a Hague Apostille Convention country that means an apostille from the local competent authority; from a non-Convention country it means legalisation through the Cyprus diplomatic mission. The certified document is then couriered to Cyprus for use.

Where a PoA is executed abroad for acts to be performed in Cyprus, it must be signed before a notary and carry an apostille (or consular legalisation). The apostille itself is a standardised certificate under the Hague Convention; in Cyprus the competent authority that issues apostilles — and that Cyprus authorities check incoming ones against — is the Ministry of Justice and Public Order.Ministry of Justice and Public Order — Apostille

A common misconception is that EU membership removes this step. It does not for powers of attorney.   1. Your Cyprus advocate drafts the PoA to the exact scope of the transaction (often bilingual Greek/English).
  2. You sign it before a notary public in your country of residence.
  3. The notary's signature is apostilled (Convention countries) or legalised at the Cyprus consulate (non-Convention countries).
  4. A certified translation is added where the receiving authority requires one.
  5. The original is couriered to Cyprus; if signed in Cyprus instead, a Certifying Officer certifies your signature and no apostille is needed for domestic use.

Can I buy Cyprus property remotely with a power of attorney?

Yes. A special PoA is the standard tool for a remote property purchase. It authorises your Cyprus advocate to sign and deposit the contract of sale, register it, apply for any required consent, and attend the transfer at the District Land Registry — so you can complete without flying to Cyprus.

The strongest protection for a buyer is depositing the contract of sale at the competent District Land Registry, which the advocate can do under the PoA. Can I use a power of attorney for company matters?

Yes. A PoA lets an advocate incorporate a Cyprus company, sign the memorandum and articles, file forms with the Registrar of Companies, and handle post-incorporation filings on your behalf — the mechanism behind remote company formation.

Note that a PoA to sign forms is not the same as being a director: director appointment, share allotment and beneficial-ownership reporting are separate obligations that the incorporating agent completes as part of the DRCOR filings.

Can a power of attorney open a Cyprus bank account?

Sometimes, but banks are the most restrictive user of PoAs. Under anti-money-laundering rules a Cyprus bank must verify the beneficial owner directly, so many banks require the account holder to appear or complete video-KYC, and accept a PoA only for specific operational acts rather than account opening itself.

Confirm the specific bank's policy before drafting, because a PoA the bank will not accept wastes the whole notarisation-and-apostille cycle.

How do I revoke a Cyprus power of attorney?

You can revoke a PoA in writing at any time before the authority has been exercised. Revocation binds the agent once the agent knows of it, and third parties once they know of it. Authority already partly exercised cannot be reversed for acts already completed, so speed and proper notice matter.

Under the Contract Law, the principal may revoke authority before it is exercised so as to bind the principal, but cannot revoke it as regards acts already done; termination takes effect against the agent when known to the agent and against third parties when known to them.Contract Law, Cap. 149 (revocation and termination of agency) Practically that means: serve a clear written revocation on the attorney, notify any authority or counterparty relying on the PoA (Land Registry, bank, Registrar), and retrieve or invalidate the original document. What does a Cyprus power of attorney cost and how long does it take?

The Cyprus-side stamping is modest — a small fixed stamp per document — but the real cost and time sit abroad: notary fees and the apostille or consular-legalisation step. Budget qualitatively for legal drafting plus foreign notarisation; timing is usually days, not weeks.

Frequently asked questions

Do I need to be in Cyprus to grant a power of attorney?
No. You can sign a Cyprus power of attorney abroad before a local notary public, then have it apostilled (for Hague Convention countries) or consular-legalised, and couriered to Cyprus. The document is then valid for use before Cyprus authorities without you ever travelling. If you are in Cyprus, you sign before a Certifying Officer instead.
What is the difference between a general and a special power of attorney?
A general power of attorney grants broad authority to act across many matters; a special (specific) power of attorney is limited to defined acts, such as signing one sale contract or applying for one permit. Generally yes. Is an apostille still needed between EU countries?
For powers of attorney, usually yes. EU Regulation 2016/1191 removed the apostille only for a defined list of civil-status public documents (birth, marriage, absence of criminal record and similar). Powers of attorney used for property, company or banking transactions fall outside that list, so notarisation plus apostille or legalisation still applies even within the EU.
