A Cyprus employer planning an individual dismissal must calculate notice from continuous service, give it in writing where required, and decide whether the employee works the period or receives lawful payment in lieu. The notice calculation is separate from the reason for dismissal: paying notice cannot cure a prohibited or otherwise unlawful termination. The Termination of Employment Law 24/1967 also has different notice bands for an employee who resigns, probation qualifications and restrictions around incapacity for work. This guide provides a case-file process for an individual termination; collective redundancy and the design of a probation clause are covered separately.
Establish the correct continuous-service date
Section 9 of the Termination of Employment Law sets the employer's minimum notice bands by continuous employment. Start with the actual commencement date and trace transfers, earlier contracts and breaks. Section 13 points to the Second Schedule for determining continuity, so a payroll start date after an internal reorganization may not settle the legal question. Ask HR for prior contracts, social-insurance records and the transfer file rather than treating the current system entry as definitive.
The ordinary employer bands begin at 26 weeks of continuous employment: one week for 26 to 51 weeks, two weeks for 52 to 103, four for 104 to 155, five for 156 to 207, six in the next band, seven in the following band and eight at 312 weeks or more. The Labour Department's published guide lists the middle bands as 208–259 and 260–311 weeks. The current consolidated statute contains awkward boundary wording around week 259, so verify the exact service date and obtain legal advice if the case lands there instead of forcing a calculation from a simplified table.
The statutory amount is a floor. Section 9(3) preserves a longer period under custom, law, collective agreement, contract or another basis, and section 9(4) invalidates a shorter contractual notice term. Check the signed employment contract and any applicable collective agreement after calculating the statutory result. If the employer promised four weeks to a person with only 60 weeks of service, the employer should not automatically replace that promise with the statutory two weeks.
For the separate trial-period rules, read the Cyprus probation guide.

Test the reason for dismissal before calculating the final cheque
Notice answers how much time or pay is due if the employer ends employment. It does not decide whether the reason is lawful. Section 5 of the Termination of Employment Law addresses grounds that do not confer compensation, while section 6 addresses the burden of proof and lists reasons that are never valid bases, including specified union, complaint, protected-characteristic, pregnancy, maternity and leave situations. Record the actual business or performance facts before sending a dismissal letter.
An employee with 26 weeks or more of continuous employment may have an unlawful-dismissal compensation claim if the termination lacks a qualifying justification. Paying eight weeks of notice to a long-service employee is not an insurance policy against a discriminatory reason. Conversely, a dismissal for genuine serious misconduct may have a no-notice route, but the statute requires assessment of the conduct and timing. An employer that waits unreasonably after learning of the alleged conduct may lose the ability to rely on summary dismissal.
Use a structured decision memo: allegation or reason, evidence, employee response where relevant, comparison cases, legal protection checks and why the chosen outcome is appropriate. Keep redundancy distinct from a personal dismissal: a role removal raises the law's separate redundancy scheme and may involve collective consultation or fund requirements. Do not label a dismissal 'performance' because it is administratively easier if the true reason is economic elimination of the role.

Deliver a written notice with a defensible last day
Section 9(5) requires the employer's notice under section 9(1) to be in writing. State the date of delivery, the legal employer, the employee, the notice duration and the intended last day of employment. Use a method that lets the company prove receipt without creating a dispute about whether a draft email was sent. Compare the date and term with the employee's actual service and any longer contractual entitlement. Calendar the payroll and benefits end date separately from the date notice is issued.
A mistake in the service calculation can shorten the period unlawfully. Check whether weekends fall within the calendar notice period and how the person's contractual working week affects pay; avoid counting only working days because the statutory bands are stated in weeks. Verify that holiday, garden leave or a proposed early exit is permitted under the contract and does not erode a statutory right. Keep a copy of the final letter and receipt in the personnel file.
The employee continues to have rights and duties during the notice period, subject to the Third Schedule and applicable contract. Section 12 allows job-search absence during normal working hours after agreement with the employer, without loss of pay, capped at eight hours a week and 40 hours overall. Plan handover and access changes around that entitlement. If a worker receives a new job offer during employer notice, section 11(2) describes an early departure route without further notice but with loss of payment for the remaining period.

Calculate and document payment in lieu of notice
Section 11(1) permits the employer to require acceptance of payment in lieu when giving notice, calculated under the Third Schedule. The employer should specify whether the worker will work all notice, part of it, or receive payment instead. The amount should reflect the remuneration legally due for the applicable notice period; do not substitute a flat 'one month's salary' where the statutory or contractual entitlement is different. Payroll should show the computation, normal pay elements considered and the separate treatment of accrued leave and other final payments.
The statute states that, for Parts II and IV, an employee receiving statutory payment in lieu is treated as employed until the notice period would have expired. That deeming rule matters when testing certain compensation or redundancy conditions and should not be ignored in a close service-length case. It does not mean the employee actually continues working. Set out the legal end date and payment treatment consistently in the letter and payroll record after reviewing the transaction-specific facts.
If the contract or collective agreement grants a longer notice period than the statute, calculate the contractual excess as well. Check tax and social-insurance treatment with payroll advisers rather than presenting every final-payment line as the same thing. An employee's consent to a settlement may resolve additional claims only if the settlement is valid; a routine payment-in-lieu instruction is not itself a waiver of unlawful-dismissal rights. Keep the final payslip and calculation available for explanation.

Do not apply the employer's notice ladder to a resignation
Section 10 sets a shorter statutory minimum when an employee resigns: one week after 26 to 51 weeks of continuous service, two weeks after 52 to 259, and three weeks after 260 or more. The employer's ladder reaches up to eight weeks; copying it onto an employee resignation is incorrect unless a valid longer contractual or other entitlement applies. The parties can agree an earlier departure, but record what they agreed and how handover and final pay will work.
Section 9(3) preserves a longer period owed to the employer under custom, law, collective agreement, contract or another basis. The legality and practical enforceability of an unusually long resignation clause may need specific review. The Labour Department FAQ also describes sector-specific arrangements for catering and hospitality that can change the analysis. Check the sector before giving a generic 'three weeks maximum' answer.
A resignation in response to the employer's conduct may raise a constructive-termination issue under section 7, which is different from a routine voluntary departure. If the employee says the workplace was intolerable or the employer breached the contract, record and investigate the complaint rather than automatically treating the file as an ordinary resignation. The final letter should reflect the true route, dates and payments.

Review probation, incapacity and summary dismissal separately
Section 9 has a probation-related no-notice proviso, and a further requirement for an agreement in writing at the start if the probation exceeds 26 weeks. Since Law 25(I)/2023 generally caps ordinary probation at six months, the two statutes must be read together for a current employee. A historic template invoking 104 weeks under the older termination text is not a safe way to create a two-year probation for an ordinary hire. Verify that probation was actually agreed, is still running and is legally valid.
The current consolidated section 9(6) restricts giving notice while an employee is absent due to incapacity for work for a period of up to 12 months, with the protection period calculated by adding the absence and one quarter of it, subject to the statute's specified qualifications. Some older official guidance describes an earlier six-month position; use the current statute for a live case. Section 9(7) also suspends notice if incapacity from a work accident arises during notice. Get a precise timeline and legal review before serving notice in a sick-leave file.
Section 5 identifies conduct that may justify dismissal without notice after consideration of all circumstances; section 15 preserves immediate termination rights related to conduct. A complaint, mistake or low performance rating does not automatically equal serious misconduct. Investigate promptly and fairly, preserve evidence and decide within a reasonable time. Where statutory notice is waived incorrectly, the employer may face notice and compensation exposure in addition to any protected-status issue.

Close pay, leave, benefits and company access as separate workstreams
Final salary is only one line of a termination account. Reconcile unpaid wages, earned but untaken annual leave, any contractually due thirteenth salary or bonus, provident-fund rules, notice pay and authorized deductions. The official annual-holidays guide says a terminating employer owes the employee annual leave or pay in lieu under the applicable rules. Do not offset leave against notice by assumption; show the basis for each item and check the agreement.
Provide any employment certificate requested at termination under section 8: it must state employment dates and the kind of work, and not include adverse remarks. Separately arrange return of property, revocation of system access and preservation of company records without preventing the worker from receiving payslips or lawful personal records. If a settlement is proposed, keep negotiation and statutory final pay distinct. Withholding undisputed wages to pressure a release creates another problem.
Document the calculations and issue a clear final statement. Where payroll correction is needed, act promptly and retain the corrected record. For a regulated worker or work-permit holder, check whether another notification or immigration step is triggered, but do not insert an assumed universal duty into an ordinary dismissal checklist. The core file should let a reviewer reconstruct service, notice, pay and the reason for termination from contemporaneous documents.

Test three notice files against the statute
An employee has 120 weeks of continuous service and an ordinary contract with no longer notice term. The employer's section 9 band is four weeks, not the employee-resignation band of two weeks. HR verifies the service record, issues written notice for the correct period or calculates lawful payment in lieu, and records the substantive reason. Four weeks' pay alone would not cure a dismissal based on pregnancy or another prohibited ground.
A second employee has 40 weeks of service, but the signed contract promises four weeks' employer notice. The statutory minimum is one week, yet the longer contractual entitlement must be checked and honoured. HR cannot rely on a handbook summary of the statutory ladder to ignore the agreed term. If the worker instead resigns, the section 10 statutory minimum is one week unless a valid longer obligation applies.
A third employee has been absent because of certified incapacity. The manager proposes an immediate notice letter and quotes an old guide saying sick-leave protection ends after six months. Counsel checks the current section 9(6) text and calculates the actual protected period, including the statutory quarter extension, before any communication. The employer separately examines its genuine reason and whether another protective regime applies. The current statute and facts, not a stale PDF, determine the safe route.
