A probation clause gives a Cyprus employer time to assess a new employee, but it is not a general exemption from employment law. Section 15 of the Transparent and Predictable Terms of Employment Law 25(I)/2023 sets a six-month maximum for ordinary employment, proportionality for fixed-term work, restrictions on a new trial for the same-role renewal, and a limited absence extension. Executive officers have a specific statutory exception that needs careful classification. Written-information and termination-notice rules are separate questions. This guide focuses on designing, administering and ending a trial period, rather than the full employment-contract checklist.

Identify the employment relationship and the applicable rule

Start with whether the person is an employee and what kind of employment relationship has been agreed. Law 25(I)/2023 is the primary source for a contractual probation period. It does not create an automatic probation period for every hire; the employment contract or relationship must provide for one. The Department of Labour Relations explains the law's general employee coverage and lists categories governed by other regimes. Check the individual's actual employment status, sector and any collective agreement before copying a standard clause.

Section 15(1) states that, in employment relationships that provide for a probation period, the period cannot exceed six months, regardless of earlier arrangements before the law began. A six-month maximum is not a recommendation to make every probation exactly six months. Choose a period justified by the work and onboarding plan. The period should have a clear start date and end date, and the manager should know when the assessment and any decision must occur.

Do not confuse the probation duration with the separate period of continuous employment that activates particular termination-notice rules. The official termination guide discusses 26 weeks and a special probation-notice position, but that does not permit an ordinary employee's probation to run for 104 weeks after the 2023 law. Read the two regimes together for the specific employee. A payroll template that still says 'two-year probation for everyone' should be reviewed rather than treated as current law.

Make fixed-term probation proportionate and avoid a repeat trial

A fixed-term employee is not automatically subject to the same six-month trial used for an indefinite contract. Section 15(1) requires the probation duration to be proportionate to the expected length of the contract or employment relationship and the nature of the work. A three-month project with a six-month probation clause is internally impossible and legally suspect. For a short engagement, explain what skill needs to be tested, how long a fair assessment takes and why the chosen period fits the assignment.

Under section 15(2), when a fixed-term contract or relationship is renewed for the same position and the same duties, a new probation period is not required. A renewal should not reset the clock merely because HR issued a fresh document or the funding code changed. Compare duties, team and role substance, not just the job title. If the work has genuinely changed, assess the legal basis for any new trial rather than assuming every renewal opens another six months.

Keep a record of the first contract's trial period and the renewal decision. If the employer has already assessed performance in the same role, repeat probation can undermine the statutory protection. Fixed-term status also raises separate rules about successive contracts, equality and contract expiry. This article addresses only the probation aspect; do not use a trial clause to solve an unrelated fixed-term classification problem.

Apply the executive-officer exception narrowly

Section 15(3) excludes certain executive officers of legal persons from the ordinary six-month maximum and same-role renewal rules. The law ties that status to a person occupying or appearing to act in a position such as director, chair, manager, secretary or similar role, by reference to the Protection of Wages Law. The Department of Labour Relations brochure describes a possible period above six months for those roles but says it may not exceed two years. Check the live statutory text and the actual role before using that exception.

An impressive job title alone should not be treated as proof that every senior employee falls within the exception. Identify whether the person is an officer of the legal entity, what authority the role actually carries and whether the person is an employee, officeholder or both. A board-appointed director with a service agreement may require a different analysis from a department manager whose title includes 'director'. The contractual documentation and company records should be consistent.

Even where the exception applies, it does not erase pay, equality, leave, protected-status or fair-treatment obligations. A two-year clause may also be inappropriate for the actual work; set an assessment plan and review the separate termination rules. If classification is uncertain, use the ordinary six-month ceiling or obtain Cyprus legal review before promising a longer trial. Do not create an executive exception simply by changing the title in an employment template.

Calculate any extension for absence against actual time away

Section 15(4) lets an employer extend a probation period when an employee was absent from work during that period, but the extension cannot exceed the period of the employee's absence. This is a bounded response to lost assessment time, not a general power to restart the trial. Identify the absence dates and the length of the proposed extension. State the revised end date and the reason in writing so the employee and manager use the same calendar.

An automatic clause allowing the employer to extend by any period it chooses is harder to reconcile with the statutory limit. If there were several absences, calculate the total actual time away and ensure the proposed added period does not exceed it. Consider whether a shorter extension is sufficient to evaluate the role. Keep the personnel data used for this calculation appropriately limited; the legal question is the period unavailable for assessment, not an invitation to circulate sensitive medical details.

Review other protective rules before taking action during or after an absence. Pregnancy, maternity, protected leave, disability and illness can involve separate legal restrictions and anti-discrimination duties. The probation extension provision is not a dismissal permission. Managers should seek advice before using the fact of protected absence as a negative performance assessment, and the employer should be able to distinguish genuine work criteria from leave-related treatment.

For broader employment protections, see the Cyprus employer guide.

Write the trial terms into the statutory employee information

Law 25(I)/2023 requires specified information about the employment relationship. Section 11(3) includes the duration and conditions of probation where one is provided. The Department of Labour Relations FAQ places that item among the basic terms to be supplied no later than seven days after employment begins. Operationally, give the worker a signed or otherwise reliably delivered document before work starts where possible, even though the statutory information deadline may be later.

Define the start, maximum duration, assessment criteria, review dates, the route for an absence extension, the notice position and any contractual benefit that changes after probation. Avoid a clause saying only 'probation applies' without identifying its length or conditions. If a collective agreement or another instrument gives the employee a more favourable position, check it alongside the statutory minimum. Law 25(I)/2023 expressly preserves more favourable provisions.

Keep the written terms and proof of delivery. A later argument about whether probation existed at all often turns on the offer letter, contract and onboarding record. Ensure payroll and HR systems use the same start date and flag the last permissible assessment day. A promotion or role change after probation should be recorded as a new employment development, not silently treated as a new trial under the old clause.

For the other information items and delivery duties, use the written employment terms checklist.

Run a fair assessment before the period expires

The legal end date is useful only if the employer actually evaluates performance before it arrives. Set job-related objectives in the first week, give access to training and tools, record feedback and schedule an intermediate review. The assessment should address the role described in the employment terms. If the problem is missing training, a changed job scope or a manager's unavailable feedback, a generic assertion that the person 'failed probation' may be weak evidence of a fair process.

Use comparable criteria for comparable staff and check any protected-characteristic or leave issue. A probation employee remains an employee, so wages, records and applicable statutory rights continue. Do not withhold earned pay or annual leave because confirmation is pending. An employer may decide a worker is not suited to the job, but the reasons and timing should be recorded contemporaneously rather than invented after a dispute.

Before extending or ending the period, have HR review the contract, the statutory maximum, any fixed-term proportionality, absences and the correct notice analysis. If an extension is justified by an absence, communicate it before the existing end date where practicable. If the employer wants to change assessment criteria or scope, explain the change and allow a reasonable opportunity to meet it. A structured file also helps the worker understand the decision.

Analyze dismissal and notice separately from probation length

The official Cyprus Termination of Employment Guide says an employer normally owes statutory notice after at least 26 weeks' continuous employment, with a particular probation exception described in the older guide. It also says that where probation is longer than 26 weeks, the no-notice position requires a written agreement made at the start of employment. Because the general probation ceiling was later set at six months in Law 25(I)/2023, do not simply reuse an old 104-week probation notice clause for an ordinary hire. Check the current termination law, contract and any more favourable arrangement for the actual dates.

A valid probation provision does not authorize dismissal for a prohibited reason. Pregnancy, discrimination, protected leave, whistleblowing or another protected activity can change the analysis regardless of service length. The employer should record the genuine performance or suitability reason, verify the date of termination, calculate pay and leave due, and deliver a clear written communication. Do not assume that the words 'during probation' remove every obligation.

Payment in lieu, notice to the employer by a resigning employee and unlawful-dismissal compensation belong to the wider termination framework. Those issues are distinct from section 15's maximum trial duration. If the employee reaches or passes the agreed end date without a decision, review the contract before asserting probation continues by default. When in doubt, treat the planned completion of probation as a real milestone and seek specific advice before a late termination.

Check three probation designs against the rules

A Cyprus company offers an indefinite-role analyst a nine-month trial. The ordinary section 15 ceiling is six months, so HR replaces the template with a shorter justified period and writes clear conditions into the employee information. It schedules reviews before the end date. Calling months seven to nine an 'assessment extension' without an actual qualifying absence would not fix the cap.

A business hires a designer for a four-month fixed-term project and proposes a six-month probation. It reduces the trial to a duration proportionate to the project and work, documents its assessment plan and records that a later same-position, same-duties renewal does not simply trigger a new probation. A changed calendar-year budget is not itself a new role.

An employee has a four-month trial but is away for three weeks during it. The employer may consider extending the assessment by no more than that actual period of absence under section 15(4), gives the worker the revised date and avoids using the absence as a negative performance mark. If the employee holds an executive office, the company separately checks whether the statutory exception truly applies before considering any longer period.

Frequently asked questions

What is the maximum ordinary probation period in Cyprus?
Section 15 of Law 25(I)/2023 caps an ordinary contractual probation period at six months. Fixed-term probation must also be proportionate to the contract and work.
Can a Cyprus employer impose a new trial after a fixed-term renewal?
Section 15(2) says a new probation period is not required on renewal for the same position and duties. Do not treat a new contract date as an automatic reset.
Can probation be extended when an employee is absent?
Section 15(4) allows an extension when the employee was absent during probation, limited to no more than the actual absence period. Other employment protections still apply.
Can a director or senior officer have a longer probation period?
Section 15(3) has a specific exception for certain executive officers of legal persons. The Labour Department brochure describes an upper two-year position, but classification and the contract must be checked for the actual officeholder.
Must a Cyprus employee be told the probation terms in writing?
Yes, where probation applies, its duration and conditions are among the basic employment information required under Law 25(I)/2023. The Department of Labour Relations says basic terms are due within seven days of starting.
Does probation mean dismissal can happen for any reason without notice?
No. Notice depends on the separate termination regime, the employee's service, written agreement and more favourable terms. Protected reasons and other employment rights continue to matter.
