A Cyprus part-time employee remains an employee. Law 76(I)/2002 prohibits less favourable treatment solely because someone works fewer hours, subject to genuine objective reasons, and applies proportionality where appropriate. Payroll must compare the employee with a suitable full-time worker or another lawful reference point, calculate pay and benefits on the right basis, and preserve protections such as leave and maternity. A shift from full-time to part-time, or back, must be managed as a voluntary change where vacancies exist. This guide focuses on equal-treatment and hour-change decisions, not on the separate minimum-wage order or general working-time limits.

Decide whether the worker falls within the part-time regime

Law 76(I)/2002 defines a part-time worker by normal hours calculated weekly or averaged over up to a year, compared with the hours of a comparable full-time worker. Start with the actual schedule, contract and payroll record, not a label such as 'casual consultant'. A worker with fewer hours may still have an employment relationship and statutory rights. A worker whose full-time hours are temporarily reduced because of partial unemployment or operational cutbacks may be in a different legal category under the law's scope rules.

The statute has an exclusion for specified casual part-time work. The consolidated text defines a casual part-time worker by limits on total weeks in a calendar year and maximum consecutive weeks, or by very low continuous weekly hours. Do not use a casual label for a regular, predictable 20-hour employee without checking the exact statutory thresholds and facts. Keep timesheets and engagement dates so an inspector or court can see whether the exception actually applies.

Part-time status and fixed-term status answer different questions. A worker can be both part-time and fixed-term, and each regime may apply. Record weekly hours, whether they vary, the type and duration of contract, and the full-time normal hours for that role. If hours fluctuate, agree the measurement period and keep the schedule history. A paper 20-hour contract that routinely requires 35 hours may not be a reliable basis for proportional pay calculations.

For the distinct renewal and conversion rules where a contract also has an end date, see fixed-term renewals.

Choose a defensible full-time comparator

The statute's comparator is normally a full-time employee in the same undertaking with the same type of employment relationship who performs the same or similar duties, taking qualifications, skills and seniority into account. A part-time bookkeeper should not be compared automatically with a full-time sales manager merely because both work in the same office. Keep a comparison note showing the job, full-time hours, pay rate, benefit scheme and any material difference in responsibility.

Section 5 provides a fallback where no suitable full-time worker exists in the business: look to the applicable collective agreement or, absent one, relevant law, collective agreements or practice. An employer with no direct full-time comparator cannot conclude that equality duties disappear. It should identify a reasoned reference and review the result against the actual work. A new sole part-time role may still have a market or collective standard and a statutory wage floor.

Comparator selection can change over time. If the full-time role is regraded, its weekly hours change or the part-time worker gains responsibilities, refresh the analysis. Keep the comparator description with the contract and pay calculation, not only in a manager's memory. If a difference is based on experience or qualifications rather than hours, state that reason explicitly and apply the same rule to full-time staff. This helps distinguish a genuine objective reason from part-time discrimination.

For the general employment-information duties that describe hours and remuneration, read written terms in Cyprus.

Calculate proportional pay without lowering the hourly value

The law defines the pro-rata principle by reference to the part-time employee's weekly hours as a proportion of the comparable full-time employee's weekly hours. If a comparable role pays €2,000 per month for 40 hours and the part-time employee works 20 hours on equivalent terms, a first-pass pro-rata base is €1,000 per month. That is a calculation example, not a substitute for checking the applicable minimum wage, collective agreement, contractual enhancements and what counts as normal hours.

Section 7 addresses equal treatment for pay and benefits and recognizes lawful proportionate treatment of monetary benefits according to hours, earnings, contributions or another applicable method. Do not assume every entitlement is exactly halved. A flat expense reimbursement, statutory leave protection or benefit with its own eligibility rule may need a different treatment. Identify each item separately: basic pay, thirteenth salary, bonus, pension or provident contribution, meal allowance and overtime trigger.

Review the effective hourly or unit rate after proportionality. Paying half salary for half hours can be lawful if the comparator and base are correct; paying 40 percent salary for half hours solely because the employee is part-time is suspect. The Department of Labour Relations FAQ gives a sector-specific minimum-wage example for a salesperson working 19 of 38 normal shop hours. Apply the relevant order to the actual occupation and period rather than treating that example as a universal 38-hour rule.

For variable schedules, reconcile the agreed normal hours with actual hours each pay period. If a worker regularly takes additional shifts, check overtime, rest, social-insurance reporting and whether the basic contracted ratio still describes the role. A top-up for extra hours should be visible on the payslip and calculated from a consistent rate. Do not wait until the annual review to discover that a nominal 20-hour employee worked close to full-time for most of the year while receiving half-time benefits.

Preserve leave, maternity and termination protections

Section 7 lists areas where part-time workers receive equal treatment and the same protection as comparable full-time staff, including annual leave with pay, paid public holidays, maternity protection, parental leave, sick leave and termination, subject to the law's applicable qualifications. A shorter weekly schedule can change the monetary or day calculation, but does not mean the employee has no leave. Payroll should calculate the actual entitlement under the governing leave law and work pattern.

A part-time employee working three long days a week may use a different leave-day accounting method from someone who works five short days. Record contracted working days, hours and the applicable leave scheme so taking one day off does not consume an arbitrary amount of annual leave. Do not announce a blanket rule that part-time staff receive 'half the holidays' without calculating the comparator, paid-public-holiday policy and statutory minimum correctly.

Social Insurance contributions and benefits follow their own rules, referenced by the part-time law. The employer should report actual insurable earnings and hours accurately; it should not promise a benefit amount from the equality principle alone. A dismissal of a part-time worker still requires a lawful reason and a notice assessment under the termination statute where applicable. The law contains narrow scope and hour-related qualifications that should be reviewed rather than assumed.

For a worker whose hours vary by season, document the reference period used for each monetary entitlement and make the leave calculation intelligible on the payslip. A simple rule of thumb may produce a wrong result if a person works full weeks during one part of the year and short weeks during another. Where the governing annual-leave scheme uses a different formula, follow that scheme and record how it interacts with part-time proportionality. The employee should be able to reproduce the amount from the hours and pay records.

For the separate notice calculation if employment ends, see Cyprus dismissal notice.

Make changes between full-time and part-time voluntary

Section 8 requires the employer to ensure that movement from full-time to part-time or the reverse, where vacancies exist, is voluntary. A worker's refusal to move between the two is not, by itself, a lawful reason to end employment, although other genuine operational grounds may still need separate assessment. Obtain the employee's informed agreement to any hour change and record the new schedule, pay and effective date. A unilateral payroll edit is not a safe transition process.

Section 9 asks employers, so far as possible, to consider requests to move from full-time to available part-time work, from part-time to full-time or to more hours where possible, and to inform staff promptly about relevant vacancies. It also addresses access to part-time work at different business levels and appropriate training. A request need not always be granted, but the employer should respond based on actual opportunities and explain the decision.

Do not treat a request for fewer hours as resignation from the current job. Discuss the proposed days, core responsibilities, client coverage, pay and review date. If the worker later seeks to increase hours, use the same vacancy and objective-criteria process used for other candidates. Keep written records of the request and response; they help show that a refusal was based on the business arrangement rather than a stereotype about part-time commitment.

For documenting changed hours and pay, use the written-terms checklist.

Give part-time staff real access to training and progression

Section 9 directs employers, where possible, to facilitate part-time access to roles at all levels, including skilled and management posts, and to appropriate training. A course held only on a part-time employee's non-working day may be formally open but practically inaccessible. Plan training schedules, compensation for attendance and performance reviews with the employee's agreed hours in mind. Compare promotion criteria with those applied to full-time workers.

Part-time status alone should not be used as a proxy for availability, leadership ability or ambition. If a specific role requires coverage at fixed hours, describe the actual requirement and consider whether job sharing or adjusted scheduling is feasible. An objective reason for a difference must relate to the role, not an untested assumption about every part-time worker. Keep the decision evidence if a promotion or opportunity is declined.

Include part-time workers in vacancy communications and workforce planning. A staff portal accessible only while on shift may miss a worker whose shift does not coincide with a short recruitment window. Give a realistic application period and record that the notice reached the relevant pool. Section 9's transition objective is easier to implement when HR tracks the employee's expressed interest in additional or fewer hours and reviews it when a position opens.

For the separate rights of fixed-term staff to vacancy information, see fixed-term employment renewals.

Test three part-time decisions

A full-time customer-service worker moves voluntarily from 40 to 24 hours each week. HR issues amended written terms and calculates salary from a suitable comparator at 60 percent, then separately checks holiday accounting and benefits. The worker remains eligible for training and promotions. The business cannot treat the employee as a new casual worker simply because the schedule changed.

A part-time engineer works 30 hours against a comparable 40-hour engineer but receives only half the comparable base pay. The employer has no objective reason for the gap. It reviews the hourly value, arrears and future rate, checks whether bonuses were also affected, and documents the correction. Calling the arrangement 'flexible' does not justify an unexplained reduction beyond the hours ratio.

A part-time administrator declines an offer to move to full-time work because of caregiving responsibilities. The refusal alone is not grounds for dismissal under section 8. The employer considers the business need separately and records whether a vacancy or other arrangement exists. Later, when a different full-time role opens, it informs part-time staff in time to apply on the same basis as other qualified candidates.

Basis and guidance: Cyprus Part-Time Employees (Prohibition of Less Favourable Treatment) Law 76(I)/2002, current text; Department of Labour: Employment Guide, part-time work and pro-rata principle; Department of Labour Relations FAQ: part-time minimum-wage calculation

Keep a comparator and hours-change audit file

The core file contains the contract and actual hours, comparator role or fallback reference, salary and benefit calculations, leave method, any objective reasons for differences, vacancy notices and written hour-change requests. Recheck it when hours, pay bands or job duties change. A pay formula that was correct at hire can become wrong if full-time normal hours shift while the part-time contract stays the same.

Train line managers and payroll staff to distinguish a lawful pro-rata monetary calculation from excluding an employee from a protection altogether. Keep policy and system fields aligned. For employees combining part-time and fixed-term status, run both legal checklists, including the fixed-term 30-month rule. For sector wage orders, check the current occupation-specific calculation as well as the general equality principle.

This article reflects Law 76(I)/2002 and official Labour Department material checked in October 2026. The exact result can depend on a collective agreement, occupation, work pattern and applicable statutory exception. A practical employer should be able to explain, in ordinary numbers, why the employee's hourly value and treatment are fair and which entitlements were pro-rated under a valid rule.

Review employee complaints against concrete comparators rather than replying that the contract was voluntarily part-time. Consent to fewer hours is not consent to an unjustified lower hourly value or loss of protected leave. Ask for the disputed pay period, relevant full-time salary, hours worked and benefit rule, then calculate the difference in a written response. If the payroll rule was wrong, correct past periods as well as the future rate and explain the adjustment so the worker can verify it.

Frequently asked questions

Must a Cyprus part-time employee receive the same hourly rate as a comparable full-time employee?
The equal-treatment rule prohibits less favourable terms solely due to part-time status without objective justification. Proportional pay should be calculated from a suitable comparator and the actual hours ratio, subject to the applicable wage rules.
How is pro-rata pay calculated in Cyprus?
The law defines a weekly-hours ratio against a comparable full-time worker where appropriate. Other benefits may follow hours, earnings, contributions or their own legal method, so calculate each item separately.
Do part-time workers get annual leave and maternity protection?
Yes, section 7 includes annual leave, maternity and other protections, subject to the relevant laws and qualifications. The amount or day calculation can reflect the real work pattern.
Can an employer force a worker from full-time to part-time?
Section 8 requires voluntary transitions between full-time and part-time where vacancies exist. Refusal of such a transfer is not by itself a reason for dismissal.
What if there is no comparable full-time worker in the business?
Section 5 directs comparison to the applicable collective agreement or, absent one, relevant law, other collective agreements or practice. The absence of a direct colleague does not end the analysis.
Must part-time employees be told about full-time vacancies?
Section 9 asks employers, so far as possible, to give timely information about full- and part-time vacancies and consider requests to change hours or employment type.
