Repeated fixed-term contracts in Cyprus are not made safe simply by writing a new end date each year. Under Law 98(I)/2003, once the relevant employee has previously accumulated 30 months or more of fixed-term employment, the contract is treated as indefinite and an end-date term ceases to apply unless the employer proves an objective reason for the fixed term. The law also protects fixed-term workers against less favourable employment terms and gives them access to vacancy information. This guide explains the renewal decision file and its interaction with probation and termination; it does not cover immigration permission or temporary-agency placement.

Identify a true fixed-term employment relationship

The legal question starts with the employee's relationship, not the document's filename. Law 98(I)/2003 covers an employment contract or relationship whose end is set by an objective condition such as a date, completion of a task or another specified event. Collect every offer letter, extension, side letter, assignment and payroll record for the same employer. A contract marked 'consultancy' may still need employment analysis if the person in fact works as an employee, while an agency relationship may require separate rules.

Record the business reason for the defined end at the start. A genuinely finite implementation project, replacement for an absent employee or defined seasonal requirement may be different from an ongoing operations role that has been budgeted only one year at a time. The law does not prohibit every fixed-term contract. It addresses abuse and asks whether the employer can justify retaining a fixed end date after the relevant accumulation. Describing the project precisely helps later reviewers test that claim.

Check the scope of the specific statute and other regimes. Public-service fixed-term workers can have separate legislation; a work permit may impose its own employment conditions, but immigration paperwork does not itself decide the employment-law classification. This guide concerns the private-sector fixed-term renewal analysis under Law 98(I)/2003. Where two regimes apply, the employer should map both rather than assuming the shorter administrative document overrides employment rights.

A contract tied to completion of a task should define what completion means and who verifies it. If the task grows into ongoing support, amend the employment record rather than treating the original milestone as an endlessly movable target. Likewise, if the end date changes because a client extends a project, preserve the client's written extension and the employee's revised terms. The objective reason should be traceable from the actual work to the proposed end, with a record made before the next term is signed.

For what an employer must tell any new employee in writing, see Cyprus employment written terms.

Aggregate the employee's prior fixed-term periods

Section 7(1) of Law 98(I)/2003 addresses a worker employed on a fixed-term contract, whether following a renewal or otherwise, who has previously worked for a total period of 30 months or more on fixed-term contracts. The statutory wording does not let the employer avoid the calculation by numbering the current document 'Contract 1' or inserting an artificial label change. Maintain a chronology of start and end dates, employer entity, role and reason for each term.

The law says the 30-month test is independent of the number of successive fixed-term contracts. A few long contracts and many short renewals therefore both require review. Do not rely on a simplistic rule that only consecutive uninterrupted service counts without examining the exact statutory language and facts. The Department of Labour Relations booklet describes the 30-month rule as an anti-abuse measure. In an individual case, obtain advice about gaps, a business transfer or a changed employing entity before deciding that earlier time can be discarded.

When the section 7 test is met, the contract is treated for all purposes as indefinite and a provision limiting its duration is ineffective unless the employer proves that fixed-term employment is justified by objective reasons. The burden is significant: the employer needs evidence, not simply a sentence saying the employee agrees to another one-year term. Review the file before the threshold is reached, not after a termination dispute.

For separate notice consequences when employment ends, read Cyprus dismissal notice.

Test an objective reason against the actual job

Section 7(2) lists examples of objective reasons, including temporary business needs, replacement of another employee, the particular nature of the work, certain probation situations and employment under a court decision. These are examples to investigate, not magic words. A maternity-cover contract should identify the absent role and expected return; a project contract should name the deliverable and expected end. Keep the underlying grant, client project or absence record rather than just the HR form.

A role used year after year to perform ordinary recurring work may not become objectively temporary because the employer approves a budget annually. Similarly, moving the same employee among minor task labels without a real operational change should be scrutinized. Review staffing forecasts and whether another person will continue substantially the same work after expiry. If the reason has ceased to exist, the employer should revise the relationship's status and terms rather than issuing another nominally fixed-term extension.

Section 7(2) mentions trial employment, but Law 25(I)/2023 separately caps ordinary contractual probation at six months and restricts a renewed same-role trial. A company cannot make an employee spend years on repeated 'probationary' fixed-term contracts by citing the older statute's example. Check the current probation rule, genuine assessment plan and total accumulated fixed-term time together. An executive-officer exception, if relevant, needs its own carefully documented status analysis.

For the distinct six-month probation framework, consult probation periods in Cyprus.

Maintain equal employment terms during every term

Section 5 says a fixed-term employee should not receive less favourable employment terms than a comparable indefinite employee solely because the contract has an end date, unless objective reasons justify the difference. The statute also refers to proportionality where necessary and equal service-period conditions for specific terms unless an objective reason supports a difference. The employer should compare pay, leave, training, benefits and evaluation rules against an appropriate worker doing the same or similar job.

A fixed-term label is not permission to withhold statutory leave or place the employee outside normal health-and-safety processes. If there is no comparable indefinite worker in the same undertaking, section 6 directs comparison to the applicable collective agreement or, absent that, relevant law, collective practice and custom. Document the chosen comparator and any objective explanation for a difference. A line in the contract that says the worker has waived equality rights is not a substitute for this analysis.

Section 8 requires employers to inform fixed-term staff of available vacancies so they have the same opportunity to seek permanent posts. A suitable general notice within the business can satisfy the information route described in the law. The employer should also facilitate appropriate training opportunities where possible. Keep proof that vacancies were announced through a channel fixed-term workers could actually access, not only through a mailing list that excludes them.

Use a pre-renewal decision note, not a form letter

Before each renewal, prepare a short decision note with the employee's chronology, total fixed-term months, current duties, original business reason, evidence that it still exists, and the expected new end. Check whether the role has changed in a way that affects comparators or probation. Confirm the person has received required employment information about the expected duration. A renewal should be signed and delivered before the prior term expires where possible, with both parties understanding the actual conditions.

If the 30-month point is approaching, have counsel test whether an objective reason can be proved. Where it cannot, update the employee record to indefinite status rather than relying on a paper end date that the statute may disregard. That may require changes to budget approval and managers' expectations, but a database field marked 'contractor ending Friday' cannot override the legal position. Explain the status clearly to payroll and the worker.

A short gap between contracts or a switch from one project code to another should be examined on its facts. The question is not only how many PDF files exist; it is whether the same employee has been kept in fixed-term employment and whether the current fixed end is objectively supported. Preserve the decision evidence while it is fresh. In a later dispute, a manager's reconstructed explanation may be less persuasive than contemporaneous project and staffing records.

For writing the expected duration correctly at onboarding, see the written-terms checklist.

Check legal status before treating the end date as expiry

The Termination of Employment Law recognizes ordinary expiry of a genuine fixed-term contract as a distinct situation, but it also allows the Labour Disputes Court to look past a fixed end where the contract or series should be treated as indefinite. Section 7 of Law 98(I)/2003 adds its 30-month conversion rule unless the employer proves objective justification. Therefore, do not tell payroll that no dismissal analysis is needed merely because a calendar reminder says the contract has expired.

Review the actual work, successive periods, any objective reason, service length, protected leave and the planned continuation of the role before ending access or issuing a final payment. If the relationship is legally indefinite, ordinary notice and lawful-termination rules may apply. If a genuine fixed term ends as agreed, calculate outstanding wages, annual leave and other contractual entitlements accurately. A project ending does not erase earned pay.

A decision not to renew can also be questioned where it is linked to pregnancy, parental leave, a discrimination ground or a complaint. Keep the commercial rationale and employee communications consistent. If the employer wants to offer a permanent role, make the terms explicit rather than allowing continued work after expiry under an undocumented arrangement. The legal status may turn on conduct as well as the printed end date.

Apply the test to three renewal patterns

An IT analyst signs three successive one-year agreements for routine support of the same product. Before a fourth document is issued, HR totals the fixed-term service and asks whether the work remains an ordinary ongoing function. A standard 'business needs' phrase is not the evidence section 7 requires. If no objective fixed end can be shown, the company treats the position as indefinite and reviews the employee's ordinary rights.

A researcher is employed for a grant with a defined end date, then receives an extension because the funder adds a time-limited deliverable. The employer keeps the grant award, revised milestone and a reason why the role ends with that work. Even after accumulated service reaches 30 months, it still has to prove an objective reason for the fixed term; the grant label alone does not automatically win the analysis. It also gives the researcher vacancy information and comparable employment terms.

An employee replaces a colleague on protected leave for a defined period. When the colleague returns, the replacement contract genuinely ends. Before ending the relationship, HR checks whether the employee had other fixed-term periods with the same employer, whether the cover role was accurately recorded and whether any suitable vacancy exists. If the employer immediately retains the same worker to fill routine work, it reassesses the status rather than rolling the replacement reason into a new annual contract.

A fourth worker has done two different temporary assignments totalling 29 months. A proposed further six-month term would cross the statutory point. The employer does not simply assert that different departments mean the earlier period is irrelevant; it totals the employment and records whether the new assignment has a provable objective end. It tells payroll and the manager how status may change and checks whether the worker's comparable terms and vacancy access have been correct throughout. This review takes place before the new contract, when the employer can still plan honestly.

Keep a defensible fixed-term register

A useful register records each worker's employer entity, first fixed-term start, every renewal, actual work, gaps, cumulative fixed-term months, objective reason evidence, vacancy notices, comparator review and end-date decision. Configure alerts well before 30 months and before each contract expiry. The alert should trigger legal review, not automatic conversion by software alone; objective reasons and the precise chronology still need human assessment.

Train managers not to promise a fresh probation on each renewal or to imply that an end date removes every employee protection. Where a role is project-funded, require the project owner to substantiate the temporary need and estimate what will happen when funding ends. Audit older long-running arrangements against the current statute, including the 2018 amendments reflected in the consolidated text. Correct payroll and HR status when evidence no longer supports a fixed term.

The law and Labour Department materials cited here were checked in October 2026. A collective agreement, sector rule or public-employment regime may change the practical answer for a particular worker. The safest decision is based on the signed documents, actual duties, cumulative months and contemporaneous objective reason. If the file cannot explain why the work genuinely has an end, issuing another template renewal can turn a manageable staffing decision into a termination dispute.

Frequently asked questions

When does a Cyprus fixed-term contract become indefinite?
Section 7 of Law 98(I)/2003 treats a contract as indefinite after the employee has previously accumulated 30 months or more of fixed-term employment, unless the employer proves objective grounds for the fixed term.
Does signing a new one-year contract reset the 30-month count?
No. The section 7 test looks at the employee's total prior fixed-term period regardless of the number of successive contracts. Analyze the actual employment history and any objective reason.
What can count as an objective reason for a fixed term?
Section 7(2) lists examples such as temporary business needs, replacement of another employee and the nature of the work. The employer must prove a genuine fact-specific reason, not merely copy a label into the contract.
Can fixed-term employees receive worse pay or leave?
Section 5 prohibits less favourable employment terms solely because of fixed-term status compared with a suitable indefinite worker, unless objective reasons justify the difference. Proportionality and service conditions also matter.
Must fixed-term employees be told about permanent vacancies?
Yes. Section 8 requires employers to inform them of available vacancies so they have equal opportunity to seek permanent posts, and to facilitate appropriate training where possible.
Can every renewal start a new probation period?
No. Law 25(I)/2023 restricts repeated probation on a same-position, same-duties fixed-term renewal and normally caps ordinary probation at six months.
